Mechanisms for ensuring the rights of migrant domestic workers: international trends and experience of Canada

Abstract

International trends and national mechanisms of ensuring of the rights of women domestic migrant workers is studied. Particular attention is given to international labor standards of the rights of migrant women, experience of different states is analyzed. Some general scientific (systemstructural, formal-logical and hermeneutical methods) and specific legal methods of knowledge (comparative and formal-legal methods) were used in order to obtain the best scientific results. International labor standards define the minimum scope of the rights that must be provided by each State. The national mechanism of effectively ensuring minimum labor standards developed in Canada is of great interest. The author proposes to use the experience of Canada to develop a national mechanism to ensure the rights of migrant domestic workers, particularly to draw up a model employment contract.
